Terms & Conditions

DDM Novastar reserves the right in its sole discretion to require prepayment from any Buyer at any time and may refuse to sell and/or withhold further shipment until all overdue balances are made current.  Buyer shall be liable for, and reimburse DDM Novastar for all costs and expenses it may incur in connection with collection of any amounts owed to DDM Novastar or enforcement of its rights, including without limitation, reasonable attorneys’ fees and expenses, court costs, and cost of collection agencies.

Any disputed amounts should be reported immediately and remitted with the undisputed amount by payment due date.  If DDM Novastar agrees with the billing dispute, DDM Novastar will credit Buyer the amount of the agreed-upon billing dispute.  All billing disputes must be made within six (6) months of the applicable invoice date, or will be deemed to be waived.

Payment Terms:
DDM Novastar accepts credit card payments only for Shopping Cart Sales.  Any purchase that incurs a charge-back or presents an invalid credit card number will be responsible for any fees or charges incurred.

Prices:    DDM Novastar reserves the right to change the prices and specifications of its products at any time without notice. Pricing is valid for US Shipments ONLY.

Terms of Sale: 
Purchase of any products sold by DDM Novastar shall be subject to and expressly limited by the terms and conditions contained herein.  No changes to, waiver of, or addition to any of these terms and conditions shall be effective unless agreed to in writing and signed by DDM Novastar.  Buyer acknowledges and agrees that these terms and conditions supersede the terms and conditions of any purchase order or other documentation used by Buyer and, except for delivery and billing addresses, and quantities prices and items ordered, any conflicting or additional terms are void and have no effect, but that Buyer may place orders by use of purchase orders and other documentation for its convenience purposes only.  Notwithstanding the foregoing, DDM Novastar reserves the right at any time to amend these terms and conditions, and Buyer shall be deemed to accept such amended terms and conditions by ordering products herein offered after the date of such agreement.  Additional special terms and conditions of DDM Novastar may be applicable with respect to certain products.

Thank you for your interest in DDM Novastar, Inc. products.  The following provisions set forth the terms and conditions on which DDM Novastar sells its products.

Return Policy:  All returns are subject to the prior authorization of DDM Novastar, in its discretion.  Buyer must notify Customer Service at 215-485-5663 and request an RMA number (Return Material Authorization).  Based on the reason for the request, the Service Dept will either authorize or deny the request for return.  Unauthorized returns will not be accepted.   All authorized return goods must be shipped Freight prepaid to the DDM Novastar location at 212 Railroad Drive, Ivyland, PA 18974,  unless goods were shipped in error. DDM Novastar will then pay shipping costs for ground shipment of returned goods within 30 days of delivery.  All returns are subject to a 25% handling/restocking charge, except for Products shipped-in-error. Credits will be issued for all authorized returns provided:

a.    Products are returned in new condition.
b.    Proper authorization has been obtained prior to return of products.
c.    Products are in their original packaging.
d.    Products are current inventory items.
e.    The Products have been shipped and billed to Buyer by DDM Novastar, and Buyer has paid for said Products.

Certain Products are not eligible for return.  These are:

a.    Products that have deteriorated because of improper handling, abuse or other factors
b.    Products that have been partly used.
c.    Products that have been involved in a special promotional sale.
d.    Broken and damaged Products.
e.    Special products made to Buyer’s specification.

Products that are to be returned for repair must be accompanied by an authorized RMA number. Credits for returned goods are conditioned upon DDM Novastar’s inspection and approval of such goods upon their return.  If DDM Novastar determines, in its discretion, that any returned goods are not eligible for return due to any reasons provided above, Buyer will not receive a credit, even if an RMA was issued.  No advance credits will be accepted.

Warranty: DDM Novastar warrants to the original purchaser that, at time of delivery, each standard product manufactured by DDM Novastar shall be free of defects in material and workmanship and, when used for the purposes and indications described within the Operator Manual.  All warranties for a product shall expire after one (1) year from the date of shipment from DDM Novastar.  DDM Novastar’s warranty hereunder shall not apply if: (i) a product is not used in accordance with its instructions or if it is used for a purpose other than indicated in the Operators Manual, (ii) any repairs, alterations or other work has been performed by Buyer or others on such item, other than work performed with DDM Novastar’s authorization and according to approved procedures; or (iii) the alleged defect is a result of abuse, misuse, improper maintenance, accident or the negligence of any party other than DDM Novastar.  The warranty set forth herein is conditioned upon proper installation, use and maintenance in accordance with applicable written recommendations of DDM Novastar.  The warranty furnished hereunder does not extend to damage to items purchased hereunder resulting in whole or in part from the use of components, accessories or supplies not furnished by DDM Novastar.

DDM Novastar’s standard warranty period is one year, but an extended product protection plan for a specific product may be purchased for minimal cost.  

Except as expressly provided herein, DDM Novastar makes no representation or warranty of any kind, expressed or implied with respect to any products, parts or services provided by DDM Novastar including, but not limited to, the implied warranties of merchant-ability and fitness for a particular purpose.  Products distributed, but not manufactured, by DDM Novastar are not warranted by DDM Novastar and Buyer must rely on the representations and warranties, if any, provided directly to the Buyer by the manufacturer of such product.  The sole and exclusive remedy for breach of any warranty is limited to the remedies provided in the paragraph above.

Technical Support: DDM Novastar offers online, phone and on-site technical support and troubleshooting for products purchased from DDM Novastar, Inc.  Within the one year warranty timeframe, online & phone support is provided at no charge.  If you have purchased a Product Protection Plan, please refer to your plan specifics for coverage information.  Please see our Technical Support Rate Schedule for products out of warranty – this includes both phone and on-site technical support and troubleshooting.

DDM Novastar’s sole obligation shall be to repair or replace, at DDM Novastar’s option, any defective component or item.  Buyer shall ship the  defective component or item to DDM,  and install its replacement at no charge to DDM Novastar.  Buyer shall bear all risk of loss or damage to returned goods while in transit.  In the event no defect or breach of warranty is discovered by DDM Novastar upon receipt of any returned item, the item will be returned to Buyer at Buyer’s expense. If defective component or item is found to be defective under warranty, then DDM Novastar will pay transportation costs back to the buyer.    

Damage or Loss in Transit: Identity of items and extent of damage or loss must be noted on Buyer’s copy of delivery document by the agent or transportation company.  If damage is discovered after receipt of shipment, notify the transportation company immediately and request that inspection be made and an inspection report rendered.  Concealed shortages or damages within shipments must be reported to DDM Novastar Customer Service within 72 hours of delivery or credit will not be allowed.  DDM Novastar will  file a claim with the carrier, providing your request is promptly forwarded to DDM Novastar and received within ten (10) days of delivery.  This claim request must be accompanied by a delivery receipt or an inspection report upon which the transportation company has properly noted such damage or loss.

Send copy of carrier freight bill to Customer Service indicating item and quantity damaged or not received.  Count and inspect your freight before carrier departs.  Damaged merchandise should not be accepted.  Please forward all information to Attn: Customer Service, DDM Novastar INC,  212 Railroad Drive, Ivyland, PA  18974.  (215-485-5663)
